HIVE Property (HIVE, we, us and our) recognise the importance of protecting your privacy. We are committed to ensuring your personal information is handled securely and with integrity.
HIVE is bound by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs). The APPs regulate the collection, use, disclosure, security and storage of personal information.
Our privacy policy sets out how we handle your personal information and how you can contact us if you want to access or correct your personal information.
What is personal information?
In our privacy policy, personal information has the same meaning as set out in the s 6(1) of the Privacy Act.
Personal information means any information or an opinion about an individual who is identifiable or who is reasonably identifiable. This may include information that identifies you such as your name, phone number or address.
Sensitive information is a subset of personal information and has a higher level of privacy protection than other personal information. Sensitive information means personal information about your racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, memberships of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record or physical or mental health, or biometric information.
What personal information do we collect?
The personal information we collect will depend on our interactions with you and the services we provide to you. This may include:
Prospective clients: (clients making enquiries): your name, phone number, email address, address,
Vendors: your name, phone number, email address, address, forms of identification and proof of ownership.
For buyers and prospective buyers: your name, phone number, email address and forms of identification.
For renters and prospective renters: your name, phone number, email address, bank statement and financial information, employment details, previous tenancy reports, family details, information about any pets and other information necessary to assess rental applications. During the course of rental inspections, we will take photos of your property to ensure it is being maintained appropriately. This may include the collection of sensitive information if, for example, you have displayed items that indicate your cultural background or provide information about your health.
For lessors: includes but is not limited to information about your name, phone number and email address, financial information (such as your bank statements), information about your property as well as property related invoices.
Prospective employees: name, email, phone number, CV, working entitlements in Australia and current salary if required.
We may also collect your sensitive information in the course of you applying for a rental application if you choose to provide it to us. For example, we may collect information about your health if you choose to volunteer that you require a property with modifications due to your existing health conditions.
Generally, we will otherwise not collect sensitive information about you unless you have voluntarily provided it to us.
Why we handle your personal information?
We collect your personal information for the purpose of enabling us to perform our functions and activities. These include:
providing appraisals of properties
acting as a real estate agent for the buying and selling of properties
property management services, including leasing properties
providing finance to you via our partner, Catalyst Advisers
marketing of our business
recruitment purposes
in the course of obtaining services from you under contract
recruitment of staff.
How do we collect your personal information?
In most instances, we collect your personal information directly from you. We will only collect information from a third party about you if it is necessary for the performance of our functions and activities, such as contacting your referee in the course of assessing your rental application or liaising with your solicitor or conveyancer in the course of selling your property.
We may also collect personal information about you if you are the other party to the sale of a property or via referrals made to us by other real estate agencies or other entities.
In some cases, where it is unreasonable or impracticable to obtain your personal information directly from you, we will seek to obtain it from others, such as from your representatives (e.g. solicitor, accountant or financial adviser) or from publicly available sources such as third-party websites including but not limited to social media. For example, we may use third-party websites to find your contact details so that we can contact you with respect to the provision of our services to you.
We will collect your personal information in the following ways:

From your rental applications
From routine inspections we undertake of your rental property
At open homes
In person when you have engaged us as your agent.
What do we do with your personal information?
We only collect your personal information for the purposes of providing you with our services and to perform our functions and activities, as described above.
We will use your personal information to:
Contact you to answer general enquiries and to provide accurate and tailored advice on our services and products.
Maintain communication with you during the selling, buying or renting process.
Find the appropriate property to match your needs
Assess your rental application or undertake an appraisal of your property
Process and respond to any complaint made by you
To provide you with information about future products, properties and services that may suit your needs
Determine whether you are a suitable candidate for employment.
Information provided by you to us will be provided to our employees on a need-to-know basis to enable them to carry out the required services.
We will disclose your personal information to:
Referees in the course of determining whether you are a suitable tenant.
Landlords in the course of assessing rental applicant details.
Utility providers, tradespeople, insurance providers or building inspectors to ensure the maintenance and suitability of rental properties.
Lawyers or conveyancers in the course of assisting with the conveyancing process of your property.
Another real estate agency for a referral where requested by you.
Government, regulatory and law enforcement authorities.
Referees in the course of determining whether you are a suitable prospective employee.
We may use third party suppliers and supervisors in the course of handling your personal information.
We use a range of third-party websites and software providers to enable us to carry out our business functions. These providers may change from time to time as we review and adopt platforms that support best business practices. Personal information may be shared with these providers for purposes including, but not limited to, issuing documents for electronic signature, facilitating sales-related services, requesting client reviews and preparing, managing, and administering appraisals, proposals, property management purposes, maintenance of properties and other business documentation.
We engage overseas contractors to assist in the performance of our business functions and activities. These contractors are subject to the Privacy Act 1988 in their handling of your personal information.
Publication of material online is considered overseas disclosure as the material can be accessed worldwide. If you submit a review for HIVE, this may be published online with only a first name and area disclosed.
Security of your personal information
We will hold your personal information in electronic or hard copy form on our own or third-party software. We will only hold your personal information for the purpose of enabling us to perform our functions and activities, which are described above
We take reasonable steps to ensure security and protect your personal information from misuse, interference and loss, as well as unauthorised access, modification and disclosure. We ensure the security of your personal information by implementing access restriction on our electronic database and securing documents within our premises.
We do not combine or link your personal information with other personal information that we hold about you.
Marketing
We may use the personal information that we hold about you, including your contact details, to provide you with information about products and services that may be of interest to you. You may opt out of receiving all or certain types of marketing information from us at any time by contacting us on the details provided below.
